ORDER
Order No. 17.01.2023 3. 1. This matter is taken up through hybrid mode.
2. This RPFAM has been filed assailing the judgment dated 20th June, 2011 passed in Cr.P. No.881 of 2010, whereby learned Judge, Family Court, Berhampur directed the Opposite Party to pay maintenance @ Rs.5,000/- per month to the Petitioner from the date of the order.
3. Mr. Samantray, learned counsel for the Petitioner prays for an adjournment stating that he has no instruction in the matter.
4. On perusal of the order sheet, it appears that after issuance of notice vide order dated 25th August, 2011, no step was taken by learned counsel for the Petitioner to get the matter listed. It further appears that the Opposite Party has not yet appeared in this RPFAM.
5. In that view of the matter, this Court is not inclined to grant the prayer made by learned counsel for the Petitioner, more particularly, when no step was taken to get the matter listed for more than eleven years. Further this Court finds that the quantum of maintenance directed to be paid by the Opposite Party appears

to be reasonable. Hence, this Court is not inclined to interfere with the same.
6. In that view of the matter, the RPFAM stands dismissed for non-prosecution.
