08. 1. This matter is taken up through hybrid mode.
2. In terms of our order dated 27.10.2022, the Appellant has filed an affidavit to the effect that, if the reasonable permanent alimony is granted in her favour, she would abandon the prayer for payment of arrear maintenance. She would also not claim any maintenance on the basis of the order passed in a proceeding under Section 125 of the Cr.P.C.
3. Mr. M.K. Mishra, learned counsel appearing for the Respondent has submitted that he has instruction to oppose the prayer for permanent alimony, as the Respondent has no income at present and he is seriously ill.
4. Be that as it may, both the Appellant and the Respondent shall file their statement of assets, liability and income in terms of the judgment of the Apex Court in Rajnesh vs. Neha and another: (2021) 2 SCC 324.
5. Let the matter be listed on 20th February, 2023.
6. Mr. S. Chakravarty, learned counsel appears for the Appellant.
7. The Registry is directed to procure the LCRs by the next date.
