05. 1. It is clear from the narration of the facts that it is only after the matter was listed for pronouncement of judgment and the Petitioner/Accused failed to turn up in the Court that he thought to file an application four years thereafter to recall PWs.2 and 4. Such an application was obviously belated and could not have been entertained by the trial Court. It was rightly rejected by the impugned order dated 2.12.2016. The Court, therefore is not inclined to interfere with the said order. While dismissing the present petition, a direction is issued that the Petitioner will appear before the trial Court on 1st March, 2023 and on that date, the trial Court will proceed further in accordance with law.
2. A copy of this order be communicated to the concerned Subordinate Court forthwith.
