01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. Heard Mr. D.J. Sahoo, learned counsel appearing for the applicant.
3. This is an application under Section 5 of the Limitation Act for condoning the delay of 5 days in preferring the appeal against the Judgment dated 22.08.2022 delivered in Civil Proceeding No.98 of 2019 by the Judge, Family Court, Dhenkanal.
4. Issue notice as to why the aforementioned delay shall not be condoned or any other order or orders shall not be passed as deemed fit or proper in the circumstances of the case.
5. Notice is made returnable on 10.02.2023.
6. Steps for service of notice on the respondent shall be taken by the applicant by 09.01.2023 by Registered Post with A.D.
7. Meanwhile, the applicant being the appellant shall remove the defects by payment of the authentication fee.
