        5.       1.      This matter is taken up through hybrid mode.

2. This RPFAM has been filed assailing the judgment dated 6th December, 2010 (Annexure-3) passed by learned Judge, Family Court, Balasore in Cr.P. No.839 of 2010 (Misc. Case No.98 of 2005), whereby the Petitioner has been directed to pay maintenance @ Rs.1000/- per month to the Opposite Party from the date of application, i.e., from 6th October, 2005.

3. Mr. Mishra, learned counsel for the Petitioner submits that he has no instruction in the matter.

4. On perusal of the order sheet, it reveals that notice could not be issued to the Opposite Party in the matter of limitation due to non-filing of requisites.

5. In view of the above, the RPFAM stands dismissed for non-prosecution.
