1. 1. Heard Mr.B.B.Mishra, learned counsel for the Appellant.
2. Even though this I.A. has been filed for condonation of
delay, but for the Stamp Reporting and looking to the date of
judgment being 24.3.2023 and the Appellant since filed the present
Appeal on 17.5.2023, this Court finds, there is no delay in fact.
3. The I.A. thus stands dropped.
4. Even though the Appeal is brought as against refusal of
divorce attempt by the Husband in disposal of C.P. No.39/2022,
learned counsel for the Appellant makes a clear statement indicating
that the Husband is still interested to get back the Wife and the
minor child herein.

5. It is keeping this in view, this Court directs issuing notice to
the Respondent by Speed Post with A.D./Registered Post with A.D.
Requisites be filed by tomorrow (23.8.2023) fixing a short
returnable date.
6. Let this matter be listed at least within one week after expiry
of the appearance date of the Wife.
