1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the petitioner and learned Addl. Standing counsel for the State.
3. Mr. B. Bhuyan. learned counsel appearing for the EOW submits that the point raised by the petitioner in the present application has already been answered by a Co-ordinate Bench and that he would like to produce the said judgment for perusal of this Court.
4. List this matter on 04.09.2023.
5. Mr. Bhuyan shall submit the judgment by way of memo after serving copy on the counsel for the petitioner.
6. In the meantime, if an application is moved on behalf of the accused seeking adjournment, the same shall be considered by the Court below having due regard to the date fixed for hearing of this case.
