                   4.     1.        This matter is taken up through hybrid mode.

2. Judgment dated 5th January, 2013 (Annexure-5) passed by learned Additional District Judge, Baripada in FAO No.22/14 of 2012 is under challenge in this writ petition, whereby dismissing the appeal learned appellate Court confirmed the order dated 29th February, 2012 passed by learned Civil Judge (Senior Division), Baripada in IA No.39 of 2011 (arising out of CS No.10 of 2011), rejecting an application filed under Order XXXIX Rules 1 and 2 CPC.

3. Learned District Judge, Mayurbhanj, by his letter dated 14th August, 2023 intimated this Court that the suit has already been disposed of since 24th December, 2013.

4. Learned counsel for the Petitioner also files a memo in Court stating that he has no instruction in the matter.

5. In view of the report received from learned District Judge, Mayurbhanj at Baripada, the writ petition is disposed of as infructuous.
