CORAM:
JUSTICE BISWANATH RATH
ORDER
Order No. 28.08.2023
01. 1. Heard learned counsel for the Parties.
2. Undisputedly, there is no challenge to the inaction of the Public Authority in failing to work out the judgment of this Court dated 07.10.2016 passed in O.J.C. No.5715 of 1999. For the opinion of this Court, provided the judgment involved herein is not varied in higher forum, the Public Authority is bound by such judgments. The Contempt Petition cannot be rejected on the ground of belated approach of the applicants to this Court.
3. Be that as it may since there is a judgment involved, the Public Authority involved herein should bring an outcome in terms of judgment dated 07.10.2016 passed in O.J.C. No.5715 of 1999, by completing the entire exercise at least within a period of two months from the date of communication of this order by the Petitioners. Failure of which, this Court will be constrained to initiate a Suo Motu Contempt against the Contemnor involved herein.
4. With this observation, the Contempt Petition stands dropped.
