01. 1. Mr. Rajib Rath, learned counsel appearing for the Appellant submits that the initial appointment of the Appellant may have been against a leave vacancy post, but it was certainly a sanctioned post. He therefore, wants to take the benefit of the decisions of the Supreme Court in State of Karnatak vs. M.L. Keshari 2010 (II) OLR SC 482 and the subsequent judgments dated 13th December, 2019 of the Supreme Court in C.A. Nos. 9413-9414 of 2019 (Rajnish Kumar Mishra v. State of U.P.) and the order dated 31st March, 2022 in C.A. No.7841 of 2011 (Man Singh v. State of U.P.).

2. Issue notice. Since Mr. Manoj Kumar Khuntia, learned Additional Government Advocate for the State accepts notice for all the Respondents, let required number of copies of the writ appeal be served on him within three working days.
