Order 25.04.2023 No. 04. 1. Mr. Panda, learned advocate appears on behalf of petitioner
and submits, inter alia, final order dated 27th June, 2018 of the State
Level Scrutiny Committee is under challenge.
2. Ms. Pattanayak, learned advocate, Additional Government
Advocate appears on behalf of State.
3. This Bench, in disposed of and pending litigation, has noticed
there is confusion regarding application of Orissa Caste Certificate
(For Scheduled Castes and Scheduled Tribes) Rules, 1980,
notifications issued pursuant to direction made by a Division Bench of
this Court with reference to judgment of the Supreme Court in
Kumari Madhuri Patil v. Addl. Commissioner, Tribal
Development reported in AIR 1995 SC 94, coming into force of

Odisha Scheduled Castes, Scheduled Tribes and Backward Classes
(Regulation of Issuance and Verification of Caste Certificates) Act,
2012 and draft rules notified thereunder. All there questions are now
before the First Division Bench of this Court in writ appeals preferred
by State. The appeals stand adjourned to 5th July, 2023.
4. In view of aforesaid, list the writ petition on 10th July, 2023.
