  1.        1.      This matter is taken up through Hybrid mode.

            2.      Judgment and        order dated 23rd October, 2017

(Annexure-1) passed by learned Judge, Family Court, Bhubaneswar in Criminal Proceeding No.100 of 2012 is under challenge in this RPFAM, whereby the Opposite Party/Husband has been directed to pay maintenance of Rs.6,300/- per month to the Petitioner/Wife with effect from the date of application, i.e., 27th July, 2012.

3. This RPFAM has been filed for enhancement of the quantum of maintenance granted under Section 125 Cr.P.C..

4. In course of hearing, Mr. Mishra, learned counsel for the Petitioner submits that in the meantime the Petitioner has suffered the decree of divorce and has filed MATA No.156 of 2019, which is sub judice before this Court. In the said MATA, an application under Section 24 of the Hindu Marriage Act, 1955 has also been filed, which is yet to be considered.

5. In view of the above, the RPFAM is disposed of with an observation that the quantum of maintenance impugned herein under Annexure-1 shall be subject to any order to be passed in MATA No.156 of 2019.
