01. 1. This matter is taken up through Hybrid Arrangement

(Virtual/Physical Mode).

2. Let the matter be listed on 20.04.2023 at the request of Mr.

S.S. Mohapatra, learned Senior Standing Counsel appearing for the

Income Tax department.

3. Meanwhile, Mr. Mohapatra, learned Senior Standing Counsel

shall take instruction over the issue of limitation vis-à-vis the apex

court Judgment on limitation concerning the period of pandemic.

4. Mr. S.K. Acharya, learned counsel appears for the petitioner.

   02.      1.      Heard Mr. S.K. Acharya, learned counsel appearing for the

            applicant.

2. At the instance of Mr. S.S. Mohapatra, learned Senior

Standing Counsel for the Income Tax department, we have adjourned

the writ petition to 20.04.2023.

3. Mr. Acharya, learned counsel has expressed his apprehension

that some actions may be taken in the meanwhile. In that premises, he

has urged for staying the further proceeding of 2 (C) CC Case No.195

of 2018 pending before the Additional Chief Judicial Magistrate

(Spl.), Cuttack.

4. The connected writ petition being WP(C) No.9647 of 2023

has been fixed on 20.04.2023. The said proceeding before the Addl.

Chief Judicial Magistrate (Spl.), Cuttack shall remain suspended till

20.04.2023.

5. Further orders will be passed on the next date. List on

20.04.2023.
