2. I.A.No.196 of 2022.

1. This matter is taken up through hybrid mode.

2. Heard Mr. P.K.Lenka, learned counsel appearing for the appellant as well as Mr. S.K.Pradhan, learned counsel appearing for the sole respondent.

3. This is an application for condonation of delay of 21 days in preferring the appeal against the judgment dated 28.01.2022 delivered in Civil Proceeding No.136 of 2020 by the Judge, Family Court, Berhampur, Ganjam.

4. Mr. Pradhan learned counsel for the respondent has fairly submitted that the respondent will not oppose the prayer for condonation of delay. That apart, we have perused the causes assigned in this application for explaining the delay.

5. We are of the view that the delay has been well explained and as such, the delay should be condoned.

6. Accordingly, it is ordered.

7. Accordingly, this application stands allowed and disposed of.

3. MATA No.114 of 2022.

1. In view of the order passed today in I.A. No.196 of 2022, this appeal is taken up for hearing.

2. Heard Mr. P.K.Lenka, learned counsel appearing for the appellant.

3. Admit.

4. Call for the LCRs, scanned or photo copies.

5. Issue notice. Notice is made returnable on 28th October,2022. Since Mr. S. K. Pradhan, learned counsel appears and waives of notice for the sole respondent, no formal notice is called for.

6. However, Mr. Lenka, learned counsel for the appellant shall provide a copy of the memo of appeal with all enclosures to Mr. Pradhan, the learned counsel for the respondent in course of the day.

7. Registry is directed to procure the LCRs by the returnable date.
