10. 1. This matter is taken up through hybrid arrangement (virtual/physical mode).
2. Learned counsel for the Appellant submits to have no instruction in the matter to further pursue the Appeal.
3. Learned counsel for the Respondent being present inviting the attention of the Court to the judgments passed by the Courts below submits that this Appeal has been filed questioning the judgment and decree passed by the learned Additional District Judge, Gajapati, Parlakhemudni in Title Appeal No.3/97 (7/97-G.D.C) whereby the judgment and decree passed by the learned Civil Judge (Sr. Division), Parlakhemundi in O.S. No.8/1988 dissolving the marriage between the parties and granting the divorce as prayed for by the Appellant (Plaintiff) have been set aside. He further submits that the present age of the Appellant would be around 68 years // 2 //
and the parties are remaining separate since March, 1983. He thus points out that here even if the Appellant would succeed it would mean a paper decree for him. Submissions are taken on record.
4. In the above state of affair, the Appeal stands dismissed. No order as to cost.
