02. 1. This matter is taken up through hybrid mode.
2. The Appellant, who is in prison, has filed a petition for engagement of a legal aid counsel for conducting his appeal.
3. From the said judgment another appeal being JCRLA No.6 of 2022 has been filed. In that appeal, Mr. D. N. Pattnaik, learned counsel represents the appeal. We are of the view that, if Mr. Pattnaik is engaged as legal aid counsel it would be beneficial to the Appellant, as the learned counsel is already acquainted with the records of the appeal.
4. Having observed thus, the Secretary, High Court Legal Services Committee is directed to engage Mr. Pattnaik as legal aid counsel for conducting the appeal being JCRLA No.21 of 2022. He shall be paid his fees according to the legal aid manual.
5. However, it appears from the impugned judgment and order of conviction and sentence dated 29.09.2021 that the Appellant has been sentenced to suffer R.I. for three years for committing offence punishable under Section 324 of the I.P.C. Hence, this appeal be placed before the learned Single Judge for hearing.
6. Accordingly, this appeal stands detagged from JCRLA No.6 of 2022.
