Learned counsel for the Appellant submits to have no instruction in the matter in prosecuting the Appeal any further.

This Second Appeal has been filed assailing the judgment and decree passed by the learned Ad hoc Additional District Judge (Fast Track), Padampur in RFA No. 4/29 of 2007, thereby dismissing the Appeal with some modifications in the judgment and decree passed by the learned Addl. Civil Judge (Junior Divison), Sohella in T.S. No. 24 of 2002.

The Appeal being of the year 2013 has not yet been admitted and is lying on board.

In the above state of affair, the Appeal stands dismissed.
