2. Heard Mr. R. Behera, learned counsel for the petitioner and Mr. T. Pattnaik, learned Additional Government Advocate.

3. This Court vide order dated 03.12.2021 directed the learned State Counsel to obtain the file in respect of Package No.OR-05-386/PMGSY-III (Batch-II) for which the petitioner has submitted his bid.

4. Mr. R. Behera, learned counsel for the petitioner contended that while passing the order of rejection of the tenders vide Annexure-7 dated 17.11.2011, the authority has not assigned any reason. Therefore, the order of rejection cannot sustain in the eye of law. To substantiate his contentions, he has relied upon the judgment in M/s. Sical

Logistic Ltd. v. Mahanadi Coalfields Limited & Ors., 2017 (II) ILR-CUT-1035 and Abhaya Kumar Sahoo v. State of Odisha, AIR 2018 (Orissa) 110.

5. Mr. T. Pattnaik, learned Additional Government Advocate contended that he will supply a list of 15 similar matters, which are pending before this Court, by way of memo so that all the matters can be taken together for adjudication and he will file counter affidavit within ten days.

6. Put up this matter after ten days.

7. Interim order passed earlier shall continue till the next date.

8. As the restrictions due to resurgence of COVID- 19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021.
