    01.     1.    This   matter   is   taken up through        Hybrid    arrangement
            (virtual/physical mode).

2. The limited grievance of the present Petitioner is that though he has submitted a representation on 09.12.2021 before the Director, Secondary Education, Odisha, Bhubaneswar, Opposite Party No.2 the same is pending till date and the authorities have not taken any decision on the said representation.

3. It is submitted by the learned counsel for the Petitioner that the case of the Petitioner is covered by the ratio decided by this Court in the matter of Santosh Kumar Hota-vrs.-State of Odisha decided in W.P.(C) No.11247 of 2009 vide order dated 15.07.2015.

4. Learned Standing Counsel for the School & Mass Education Department submits that he has no objection if a direction is issued to the Opposite Parties to consider the representation of the Petitioner in accordance with law and in the light of the judgment relied upon // 2 //

by the learned counsel for the Petitioner.

5. In view of the aforesaid facts and circumstances, this writ application is disposed of with a direction to Opposite Party No.2 to consider the representation of the Petitioner dated.09.12.2021 if such representation is pending, within a period of 10 weeks from the date of production of certified copy of this order.

6. It is needless to mention here that the representation shall be considered strictly in accordance with law and dispose of by passing a reasoned and speaking order. Decision so taken on the representation of the Petitioner be communicated to the Petitioner within 10 days thereafter.

7. With the aforesaid observation the writ application shall stand disposed of.
