05. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard Mr. G.R. Sethi, learned counsel for the Petitioner and Mr. D.K. Mohanty, learned Addl. Standing Counsel appearing for the Opp. Parties.

3. Copy of the Judgment passed in S.T Case No. 220 of 2012 showing the acquittal of the Petitioner from the Criminal Case is filed in Court today. The same be kept on record.

4. Mr. Sethi also contended that similar issue has already been decided by this Court in its Judgment dtd.06.09.2022 passed in W.P.C.(OAC) No. 1058 of 2016. Copy of the said Judgment was also served on Mr. Mohanty, learned ASC in Court today. Mr. Mohanty, learned ASC is directed to go through the same and apprise this Court with regard to its applicability on the next date.
