01. 1. Mr. Behera, learned advocate appears on behalf of petitioner
and submits, by inadvertent error, the appeal to be preferred was
styled as writ petition. Application for condonation of delay and leave
to file appeal without the certified copy have been filed.
Subsequently, application being I.A. no.16146 of 2022 for change of
nomenclature was also filed. Ms. Naidu, learned advocate appears on
behalf of the Commissioner.
2. We find judgment dated 30th June, 2022 was made on appeal
preferred by petitioner. In sub-section (2) in section 44 of Odisha
// 2 //
Hindu Religious Endowments Act, 1951 provides for appeal to the
High Court. Assignment for such appeal is with the single Bench.
3. The writ petition along with all applications are released from
the list to be placed before the Bench having assignment.
