Order No. This matter is taken up through hybrid mode.

2. Heard Mr. R. Mishra, learned counsel for the petitioner and Mr. S. Jena, learned Standing Counsel for School and Mass Education Department.

3. The petitioner files this writ application seeking direction to the opposite parties to declare him as Headmaster of Palla Totapada High School in the district of Khurda.

4. Mr. R. Mishra, learned counsel for the petitioner states that since the petitioner is working as Headmaster in-charge, he should be declared as regular Headmaster of Palla Totapada High School in the district of Khurda and be extended with all benefits as due and admissible to him in accordance with law.

5. Mr. S. Jena, learned Standing Counsel for School and Mass Education Department has contended that the matter has been considered by the apex Court in Pabitra Mohan Dash etc. v. State

of Orissa, AIR 2001 SC 560, therefore the petitioner's case may be considered in the light of the judgment passed by the apex Court in the said case.

6. Considering the submissions made by learned counsel for the parties and after going through the record, this Court disposes of the writ petition with the direction to the opposite parties that the claim of the petitioner be considered in the light of the judgment of the apex Court in the case of Pabitra Mohan Dash (supra), as expeditiously as possible, preferably within a period of three months from the date of communication of this order.

7. With the above observation and direction, the writ petition stands disposed of.
