2. Heard.

3. The petitioner has filed this writ petition seeking direction to the opposite parties to grant grade pay of Rs.5400/- in favour of the petitioner as 3rd RACP benefit with effect from 01.01.2015 and pay band of Rs.9,300/- to Rs.34,800/- with effect from 01.10.2014 taking into consideration the judgment passed in the case of State of Orissa and others Vrs. Biharilal Barik and others in W.P.(C) No. 2831 of 2016 dated 27.06.2016.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to opposite party no.2 vide Annexure-8 and the same may be directed to be considered, taking into consideration Annexure-6, within a stipulated time, to which learned counsel for the State has no objection.

5. As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.2 to consider the representation filed by the petitioner vide Annexure-8 taking into consideration Annexure-6 and the decision in the case of Biharilal Barik (supra) and pass appropriate order in accordance with law, within a period of three months from the date of production of certified copy this order.

Issue urgent certified copy as per rules.
