2. Heard Mr. G.M. Rath, learned counsel for the petitioner and Mr. D. Nayak, learned counsel for Food Corporation of India.

3. The petitioner has filed this writ petition seeking direction to the opposite parties to maintain his original seniority in the feeder cadre of Asst. General Manager (General) and consider his future promotion basing on the panel of 2013 instead of panel of 2015 in conformity with the notification dated 02.02.2010 and Office Memorandum dated 10.12.2013 of the Government of India in Ministry of Personnel, Public Grievances and Pensions, Department of Personnel & Training.

4. Mr. G.M. Rath, learned counsel for the petitioner contended that similar question had come up for consideration before the Punjab & Haryana High Court in Surender Singh Taxak v. Union of India (Civil Writ Petition No.6978 of 2016 (O&M) decided on 22.11.2019).

Therefore, the case of the petitioner be considered in the light of judgment passed by the Punjab & Haryana High Court in Surender Singh Taxak (supra). He further contended that the petitioner may be permitted to file a fresh representation before the authority highlighting the grievances, and the same may be directed to be disposed of within a stipulated time taking into consideration Annexure-8, to which Mr. D. Nayak, learned counsel appearing for the opposite parties has no objection.

Considering the facts and circumstances of this case, but, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of with the direction that in case the petitioner, with regard to the grievance made in this petition, files a fresh comprehensive representation before the authority within 15 days hence, the same shall be considered by the said authority taking into consideration Annexure-8, and pass appropriate order, as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with the certified copy of this order.

Issue urgent certified copy as per rules.
