Heard.
In our considered opinion, there is no delay in
preferring the appeal as the judgment impugned had
been passed on 06.02.2020 and the appeal should have
been preferred by 06.03.2020. By 06.03.2020, the Corona
pandemic has already started. Such fact was taken note
of by the Hon'ble Supreme Court and the Hon'ble
Supreme Court has ordered that in such cases limitation
should not be counted.
So taking the above circumstances into
account, we are inclined to condone the delay by holding
that the appeal has been preferred in time.
The I.A. is accordingly disposed of.
