WPC(OAC) No.997 of 2015

Heard Mr. B.P. Satapathy, learned counsel for Petitioner and Mr. H.K. Panigrahi, learned Additional Standing Counsel for the Opposite Parties.

Since the Petitioner's case is similar to that of the Petitioner's case in WPC(OAC) No.1823 of 2015, this case is also covered by the judgment passed by this Court in WPC(OAC) No.1823 of 2015 on 21.06.2021. Applying the above decision the impugned order herein is also set aside. Petitioner be immediately brought over to the work- charged establishment and placed above his juniors already brought to the work-charged establishment with payment of differential salary and other benefits, if any, from the date his juniors were entitled along with 6% interest all through. The entire exercise may be completed within a period of six weeks from the date of service of a copy of this order along with a copy of the judgment dated 21.06.2021 in WPC(OAC) No.1823 of 2015.

The writ petition succeeds. No cost.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021.
