2. Heard learned counsel for the petitioners and learned
Additional Government Advocate.
3. This Writ Petition has been filed by the petitioners seeking
for a direction to the opposite parties to sanction and disburse the
compensation amount for acquisition of their land for the purpose
of construction of Upper Indravati Irrigation Project, Kusumkhunti
as per the judgment dated 14th November, 2018 passed by the
learned Civil Judge (Senior Division), Dharamgarh in L.A.R. No.90
of 2010.
4. Learned counsel for the petitioners submitted that pursuant
to an application filed under Section 18 of the Land Acquisition
Act, 1894, L.A.R. No.90 of 2010 was registered before the learned
Civil Judge (Senior Division), Dharamgarh. The court below by
judgment dated 14th November, 2018 answered the reference.
However, no action has been taken as yet for sanction and
disbursement of the compensation amount. He further submitted
that a similar Writ Petition bearing W.P.(C) No.11296 of 2019 has
been disposed of on 30.07.2019 directing opposite party No.1 to
sanction the amount at an early stage and to take expeditious
steps for disbursement of the compensation amount. He also
submitted that the present Writ Petition may be disposed of in
terms of the order passed in that Writ Petition. Learned Additional
Government Advocate has also no objection to the aforesaid

submission made by learned counsel for the petitioners.
5. In view of the above, this Court disposes of this Writ Petition

with a direction to opposite party No.1 to sanction the amount at an
early stage and thereafter opposite party No.3-Special Land
Acquisition Officer, Kusumkhunti shall take consequential steps for
disbursement of the compensation amount in favour of the
petitioners, if there will be no impediment. The entire exercise shall
be completed as expeditiously as possible, preferably by end of
May, 2021 on production of a copy of this order.
6. As there are certain restrictions due to pandemic COVID-19
situation are continuing, learned counsel for the parties may utilize
a soft copy of this order available in the High Court's website or
print out thereof at par with certified copy in the manner
prescribed, vide Court's Notice No.4587, dated 25th March, 2020.
