                                    W.P.(C) No.1472 of 2021




02. 20.01.2021               This    matter   is   taken   up   through    video
                 conferencing.
                             Heard learned counsel for the parties.
                             This writ petition involves the following prayer :
                                  "It is therefore prayed that this Hon'ble
                          Court be pleased to pass following relief (s) :-

                                     (i)  The Hon'ble Court be pleased to
                                    admit & allow the writ petition,

                                    (ii)   The Hon'ble Court be pleased to
                                    direct the opp. Parties to allow the 1st/2nd
                                    RACPs benefits in the cadre of MPHW(M)
                                    in favour of the petitioner by granting &
                                    fixing his basic pay in the time scale of his
                                    promotional post in P.B.-2 i.e. Rs.9,300/-
                                    to Rs.34,800/- with G.P. Rs.4200/- w.e.f.
                                    2910.2013 in accordance with Annexure-
                                    4, 5 & 8 so also keeping in view of the
                                    judgment/ order passed by this Hon'ble
                                    Court as well as Hon'ble Apex Court in the
                                    case of Biharilal Barik under Annexure-6
                                    & 7 by revising the pay & pension of the
                                    petitioner along with the consequential
                                    benefits as due & admissible in his favour
                                    within a time bound period for the interest
                                    of justice."

                             Looking to the prayer made in this writ petition
                 and as a decision in the matter is required to be taken by the
                 opposite party No.1, this writ petition stands disposed of
                 with a direction to the opposite party no.1 to consider the
                 request of the petitioner involved in this writ petition by
                 treating the same as a representation at the instance of the
                 petitioner and take a lawful decision in the matter, taking
                 into account the plea raised in the writ petition as well as the
       judgment appended thereto. The entire exercise shall be
      completed within a period of two months from the date of
      communication of a copy of this order along with a copy of
      the writ petition by the petitioner.
                   The writ petition thus stands disposed of.
                   Petitioner may utilize the soft copy of this order
      available in the High Court's website or print out thereof at
      par with certified copy in the manner prescribed, vide
      Court's Notification No.4587 dated 25.3.2020.
