Conferencing.
Heard learned counsel for the parties.
Petitioner has represented vide Annexure-4 on
selfsame issue. Thus this writ petition is not entertainable at
this stage. However, in disposal of the writ petition as not
entertainable at the stage, this Court directs the
Commissioner-cum-Secretary, Higher Education Department,
Bhubaneswar, opposite party no.1 to consider the request of
the petitioner vide Annexure-4 taking into account the plea in
the writ petition, the provision in Odisha Aided Educational
Institutions Employees Retirement Benefit Rules, 1981 and
also the applicability of the judgment in the case of Sarat
Chandra Parida Vrs. State of Odisha and others, reported
in 120 (2015) CLT 813. The entire exercise be concluded
within two months from the date of communication of copy of
this order, copy of the writ petition as well as the citation
relied on by the petitioner.
As restrictions are continuing for COVID-19,
learned counsel may utilize the soft copy of this order
available in the High Court's website or print out thereof at
par with certified copies in the manner prescribed, vide
Court's Notice No.4587, dated 25.03.2020.
