This matter is taken up through Video Conferencing
in the wake of Lockdown due to Pandemic COVID-19.
Heard Mr. P.K. Panda, learned Standing Counsel for
the School & Mass Education Department and Mr. B.
Routray, learned senior counsel for the respondents.
Mr. B. Routray, learned senior counsel for the
respondents by referring to the affidavit filed on behalf of
the respondents submitted that the case of the respondents
pertains to the 110 Girls' Schools. The judgments in the
case of State of Odisha v. Loknath Behera and in the case of
Anup Senapati are not applicable as the same are
distinguishable. The judgment rendered in Loknath Behera
relied upon by the State Government, was relating to the
case of colleges and the said judgments cannot be made
dutta
applicable to the 110 Girls' Schools including 21 Girls'
Schools who have been already received G.I.A. in terms of
G.I.A. Order, 1994 and financial benefit w.e.f. 01.06.1994.
Since the matter requires consideration and
adjudication, put up this matter on 18.02.2021 under the
same heading.
