24. 12.01.2021 I.A. No.1126 of 2020 This matter is taken up through Video conferencing because of COVID-19 pandemic.
Heard Mr. P.C. Jena, learned Advocate appearing for the petitioner/appellant no.1 and Mr. M.S. Sahoo, learned Additional Government Advocate for the State.
This application has been filed by the
petitioner/appellant no.1-Mrutyunja Patra for grant of
interim bail in his favour on the ground of his illness.
Mr. P.C. Jena, learned counsel for the petitioner/ appellant no.1 submits that the petitioner/ appellant no.1 is suffering from number of diseases and he is very old for which effective treatment cannot be given to him in jail.
Perused the report of the Senior Superintendent of Circle Jail, Baripada.
The impugned judgment reveals that in the year 2014, the petitioner/ appellant no.1 was 58 years old. But, in the appeal memo it is claimed by the petitioner/ appellant no.1 himself that he was 73 years old. Now it is claimed by Mr. P.C. Jena, learned counsel for the petitioner/ appellant no.1 that he is almost 80 years old. The report submitted by the jail official shows that the petitioner/ appellant no.1 is suffering from Hypertension, Diabetes Mellitus, Defective Vision and suspected Hernia for which treatment is being given to him.
Learned counsel for the petitioner/ appellant no.1 prays for release of the petitioner/ appellant no.1 on interim bail for three months.
Keeping in view the advanced age of the petitioner/ appellant no.1, the current COVID-19 pandemic and the health condition of the petitioner/ appellant no.1 as reported by the Senior Superintendent of Circle Jail, Baripada (Welfare Services), we are inclined to release the petitioner/ appellant no.1 on interim bail for his better treatment.
Accordingly, the application for grant of interim bail filed by the petitioner/ appellant no.1 is allowed.
Let the petitioner/ appellant no.1- Mrutyunja Patra be released on interim bail for a period of forty-five days to be reckoned from the date of his release, by the learned Additional Sessions Judge-I, Baripada in S.T. No.13/98 of 2009-08 on suitable terms and conditions as deemed just and proper by him.
After completion of the interim bail period, the petitioner/ appellant no.1 shall surrender before the aforesaid court, failing which appropriate warrant shall be issued for his production.
Accordingly, the I.A. is disposed of.
As restrictions are continuing due to COVID-19 pandemic, learned counsel for the parties may utilize the soft copy of this order available in the High Court's official website or print out thereof at par with certified copies in the manner prescribed, vide Court's Notice No.4587, dated 25.03.2020.
