07.12.2021

RVWPET (RPC) No.47 of 2020 And I.A. No.42 of 2021

Order No. The matter is taken up through hybrid mode.

2. Heard learned counsel for the petitioner.

3. This application has been filed for condonation of delay of filing the RVWPET (RPC) by recalling the order dated 16.11.1999.

4. On perusal of the application, it appears that delay in filing the RVWPET (RPC) for the period from 28.12.1999 to 13.07.2000 has not been properly explained.

5. In view of the judgment passed by this Court in State of Orissa and another v. Bishnupriya Routray and another, 118 (2014) CLT 588, this Court is not inclined to condone the delay of the aforesaid period in filing the RVWPET (RPC).

6. Accordingly, the I.A. stands dismissed and consequentially, RVWPET (RPC) stands dismissed.
