JUDGMENT AND ORDER (ORAL)
1. This instant Misc. application has been filed seeking
substitution of the appellant's daughter-in-law stated to be the
representative of the estate of the deceased person.
2. On the earlier occasion, the respondent had sought time to
file objections to the proposed substitution, however, today the learned
counsel for the respondent submits that he has no objection to the
substitution application, substituting the applicant in place of the
deceased appellant.
3. Perused the application for substitution. The grounds as
made out in Para-4, shows that the transfer of the suit property was as
far back as on 20.03.2006, in favour of the applicant.
4. In this view of the matter, the substitution application is
allowed and this Misc. Case stands closed and is accordingly disposed
of.
