The respondent vide affidavit dated 25-01-2022 has raised objection to the maintainability of the appeal as also the application for stay and condonation of delay.

Mr. S.Sen, learned Sr. GA prays that he may be allowed to file reply to the said objection and further submits that vide order dated 28-10-2021, this Court on hearing the parties had directed the registry to compute the Court Fee payable as per a judgment rendered in the case of Indore Development Authority vs. Tarak Singh & Ors. reported in 1995 Supp (3) SCC 25.

Today, Mr. S.Sen, learned Sr. GA submits that the said provision on which the Court Fee has been computed by this registry is not available in the said Act and as such prays that the matter may be looked into afresh.

In consideration of the submission so advanced, it would be in the fitness of things that an appropriate application be filed seeking clarification or correction to the order dated 28-10-2021.

Accordingly, list this matter on 01-03-2022 for further consideration.
