21.08.2025 Learned senior counsel Mr. HS Paonam for the applicant/petitioner in this matter is present before the court physically. However, the office notings reveals that the miscellaneous case proceeding is filed seeking some sort of permission to file the proceedings by a third party. Whereas the learned senior counsel in this matter is seeking some short accommodation to appraise the issue.
Whereas, the learned GA Mr. S. Niranjan is present before the Court on behalf of the respondent/State and similarly, the learned counsel Mr. K. Roshan for the private respondents is also present and wherein the learned GA is seeking some short accommodation despite of this review petition has been filed and also seeking permission by a third party and therefore, the learned GA be directed to clarify the position of the judgment rendered by the Hon'ble Supreme Court of India in the year 2023 i.e., on 31st October, 2023 in the case of Sanjay Kumar Agarwal and Ors. Vs. State Tax Officer (1) and Ors. reported in (2024)2 SCC 362.
