Heard Mr. S. Samarjeet, learned CGC, appearing for the applicants.

Mr. S. Jibon Singh, learned counsel for the respondents, states that he

has no objection to this condone delay application being considered on its own

merits and subject to terms.

The delay in the presentation of this appeal is 134 days. The reason

cited therefor is that the learned counsel who appeared for the

applicants/appellants before the Tribunal was unwell and could not take steps

immediately after the pronouncement of the judgment and order, presently

under appeal. Even thereafter, it appears that there was some delay in

securing a legal opinion.

It is not open to the Union of India to claim lenience only on the ground

that it has to process filing of an appeal at different levels and bureaucratic

red-tape is time consuming. However, as the delay is negligible and acceptable reasons have been offered therefor, it can be condoned upon imposition of

costs.

The delay is therefore condoned upon payment of costs of Rs. 500/- to

the 1st respondent, who shall receive it for herself and on behalf of all the

respondents, under proper acknowledgment.

Upon production of the receipt in proof of payment of such costs, the

Registry shall verify as to whether the appeal is otherwise in order and list the

same for hearing after numbering it.

Application is disposed of accordingly.

A copy of this order shall be supplied online or through whatsapp to the

learned counsel for the parties.
