By this Misc Application, the Central Bureau of Investigation
(CBI) is praying for another 6 (six) months' time for completing the
investigation into the conduct of the Main Examination held by the Manipur
Public Service Commission in the year 2016.
This Court by a common judgment and order dated 18.10.2019
in Writ Appeal No.19 of 2017 with WA No.29 of 2017, WP(C) No.606 of 2017,
WP(C) No.725 of 2017 and WP(C) No.313 of 2018 had directed the CBI to
investigate into the conduct of the Main Examination, 2016 by the Manipur
Public Service Commission within a period of 3 (three) months from the date
of receipt of the judgment and order.
Thereafter, the CBI had approached this Court by way of MC
(WA) No.17 of 2020 praying for 6 (six) months' time for completing the
investigation. By an order dated 21.02.2020 this Court had granted 6 (six)
months' time for completion of the investigation with the direction to submit
interim report towards the progress of the investigation every month in a
sealed cover.
Another MC (WA) No.45 of 2020 was filed by the CBI again
praying for 6 (six) months' time for completion of the investigation. By order
dated 23.07.2020 this Court had granted 6 (six) months' further time to the
CBI for completion of the investigation.
The CBI again filed MC (WA) No.3 of 2021 praying for another
6 (six) months' time to complete the investigation as directed by this Court.
By order dated 26.02.2021 this Court granted last and final extension of time
to the CBI to complete the investigation within a period of 6 (six) months from
31.01.2021.
In the present application, the CBI is again praying for
extension of 6 (six) months' time w.e.f. 31.01.2021 to allow them to complete
the investigation and they have given reasons as to why the investigation
could not be completed within the specified period as directed by this Court
on 26.02.2021 in MC (WA) No.3 of 2021.
However, on perusal of the explanation given by the CBI,
though a final and last chance was given to the CBI by the order dated
26.02.2021 in MC (WA) No.3 of 2021, we are of the considered opinion that
it would be in the interest of justice to permit the CBI another further extension
of 6 (six) months.
Accordingly, the Central Bureau of Investigation (CBI) is
allowed a further extension of 6 (six) months' time w.e.f. today.
It is made clear that this shall be the last and final chance to the
CBI to complete the investigation as directed by this Court in the common
judgment and order dated 18.10.2019.
We also make it very clear that no further application for
extension of time shall be entertained by this Court.
With the above directions, this Misc Application stands
disposed of.
