ORDER
This writ petition has been filed challenging the impugned Form A Notice dated
01.09.2021 issued by the 2nd Respondent in Ref.No. PO/SIP/PPKM/Enco
Engineers/2021 and the consequential Form B Notice dated 16.04.2026 issued by
the 2nd Respondent in Ref.No. PO/SIP/PPKM/Enco/33/2011 and Form C Notice
dated 05.05.2026 issued by the 2nd Respondent in Ref.No.
PO/SIP/PPKM/Enco/33/2011 and to consequently direct the 1st and 2nd
Respondents to re-allot the Plot No. A-16, admeasuring 2.69 acres in SIPCOT
Industrial Park at Pillaipakkam, in favour of the Petitioner upon payment of 20
percent of the differential plot cost by considering the representation of the
Petitioner dated 11.05.2026.
2. Mr.Naveen Kumar Murthi, learned counsel for the petitioner submits that
the petitioner has given a representation dated 11.05.2026 seeking to pass
appropriate orders permitting him to pay 20% of the differential plot cost with
respect to the plot allotted to him, which allotment was subsequently cancelled and
now the impugned order of eviction has been passed by the respondents. He seeks
the indulgence of this Court to set aside the impugned order and for directing the
respondents to favourably consider the representation dated 11.05.2026 for
payment of differential plot cost.

3. In support of his submission, learned counsel draws the attention of this
Court to the order passed by a Division Bench of this Court in a writ appeal filed by a
similarly placed industrial establishment in W.A.No.1083 of 2026, wherein the
Division Bench of this Court has passed an order dated 29.04.2026 keeping the
eviction order in abeyance based on the undertaking given by the appellant therein
to deposit the differential amount as per the Scheme. Learned counsel for the
petitioner seeks the indulgence of this Court to extend the same benefit to the
petitioner, as he is ready and willing to pay the differential plot cost as stated in his
representation dated 11.05.2026.
3. Mr.M.Murali, learned Government Advocate appearing for the respondents
submits that the writ appeal filed by the petitioner in W.A.No.972 of 2022 was
dismissed and challenging the same, the petitioner filed S.L.P.(Civil) No.9591 of
2026, which was also dismissed by the Hon'ble Supreme Court vide order dated
20.03.2026, confirming the order passed by the Division Bench of this Court,
pursuant to which only the impugned Form ‘B’ notice dated 16.04.2026 was issued
by the respondent.
4. Heard the submissions made by the learned counsel appearing for both
sides. Admittedly, the plot has been allotted to the petitioner as early as in the year
2021 and the petitioner has utilized the same by putting up construction for trial

production. The allotment was cancelled by order dated 23.03.2021, which was
challenged by the petitioner in W.P.No.8711 of 2021, and the said writ petition was
allowed. Challenging the same, the respondents preferred a writ appeal in
W.A.No.972 of 2022 against the said order, which was allowed by the Division Bench
by order dated 06.02.2026. Aggrieved by the same, the petitioner preferred a
special leave petition in S.L.P.(Civil) No.9591 of 2026 before the Hon’ble Supreme
Court, which was dismissed in limine.
5. Now, since the petitioner vide his representation dated 11.05.2026 is ready
and willing to pay the differential plot cost and also in the light of the order passed
by the Division Bench of this Court in W.A.No.1083 of 2026 in respect of a similarly
placed industrial establishment, this Court is inclined to grant an interim order to
keep the eviction process in abeyance until further orders.
6. Post the writ petition for hearing on 16.06.2026. Counter to be filed by
the respondents by then.
