                                                         ORDER

Seeking a direction to the first and second respondent to permit the

petitioner to apply and appear in the B.A. LLB Examination to be conducted in

the third respondent’s College till the petitioner get pass in all the examinations,

this Writ Petition has been filed.

2. The petitioner has studied in the third respondent’s college from the

Academic year 2017-2018 till the Academic year 2021-2022 i.e. for a period of

five years. The petitioner, bearing Registration No.51711221, has passed

several papers except four papers, namely, Human Rights Law, Law and

Economics, Law of Crimes, and Family Law-II. When the petitioner joined five

years B.A., L.L.B., Course, the first respondent University/third respondent

College did not impose any regulations and conditions. Similarly, in the

examination schedule dated 13.04.2026 issued by the second

respondent/Controller of Examinations, no conditions are imposed regarding the

number of attempts within which a candidate should clear the examinations.

However, in the instructions dated 22.04.2026 issued by the second respondent

for the Academic year 2025 – 2026, it is stated that five year course students

admitted prior to the Academic year 2018-2019, are not permitted as per UGC

guidelines relating Uniform Span Period (N +2) i.e. candidates can write exams

only up to 2 years after the regular course is completed. However, such __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 19307of 2026

restrictions were not imposed when the course was commenced and suddenly in

the current academic year, such as onerous condition is imposed. When the

petitioner attempted to pay the examination fees in the online portal, the portal

rejected the petitioner stating that the registration number is invalid.

3. The petitioner has passed four papers and this action of the first

respondent Tamil Nadu Dr.Ambedkar Law University has put him into

irreparable injury. The University is not allowing the petitioner to pay the exam

fee and to appear in the examinations. The petitioner’s first examination is

scheduled on 13.05.2026 and the other three papers are scheduled on

21.05.2026, 02.06.2026 and 05.06.2026. Therefore, the petitioner, having no

other option, sent a detailed representation through e-mails dated 27.04.2026

and 04.05.2026, to the first and second respondents in this regard. However, the

first and second respondents have not sent any reply so far. Aggrieved against

the non-grant of permission to the petitioner to apply for the examinations, and

considering the urgency since the examinations are commencing on 13.05.2026,

the present writ petition has been filed.

4. Learned counsel for the petitioner submitted that similarly placed

candidates filed a batch of writ petitions before the Madurai Bench of this Court

in W.P.(MD) Nos.13253 to 13258 of 2026 and this Court by an order dated

29.04.2026 permitted those candidates to attend the examinations and to pay __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 19307of 2026

necessary fees. Hence, the learned counsel for the petitioner sought similar

indulgence from this Court by following the said order.

5. The learned counsel appearing for the second and third respondents

submitted that they would inform the first respondent regarding the necessary

instructions.

6. Heard the learned counsel appearing on either side and carefully

perused the materials available on record.

7. Fully fortified by the order passed by this Court in W.P.(MD)

Nos.13253 to 13258 of 2026 dated 29.04.2026, this Court is of the considered

view that the petitioner should also be given the benefit of writing the

examinations. Hence, the respondents are directed to open the online portal

facilitating the petitioner to pay the necessary examination fee and permit the

petitioner to write the supplementary examinations scheduled from 13.05.2026

to 05.06.2026. It is made clear that the permission granted by this Court to write

the examinations shall be subject to the outcome of the writ petition.

8. List the case on 15.06.2026.
