                     at Kovilpatti, dated 26.07.2004 in O.S.No.66 of 2002.

submit that during pendency of appeal, appellant had died and the matter

stands abated. He also made the following endorsement:

“In this second appellant Appellant S.Sellappan is deceased date of death is not known. This second appeal may be dismissed as abated.”

2. In view thereof, this second appeal is dismissed as abated. No

costs. Consequently, connected miscellaneous petition is closed.
