ORDER
(1) The petitioner has filed the above miscellaneous petition seeking to stay
the operation of the judgment and decree dated 26.9.2025 made in
OS.No.133/2024 on the file of the Learned II Additional District and
Sessions Judge Arakkonam, pending disposal of the Appeal.

(2) The learned counsel for the petitioner submitted that the Trial Court
failed to note that under Section 114[e] of the Indian Evidence Act, there
is a presumption that the judicial and official acts were performed
regularly. The learned counsel further submitted that the
plaintiffs/respondents 1 to 7 have casually stated that the suit summons
was not served on the defendants and a fraud was played on the Court.
The learned counsel submitted that except the ipsi dixit of the plaintiffs,
there is absolutely no evidence for proof of the said allegation. Under the
circumstances, the learned counsel for the petitioner submitted that an
order of interim stay be granted pending disposal of the Appeal.
(3) This Court finds that a prima facie case has been made out for grant of
interim orders and the balance of convenience is also in favour of the
petitioner.
(4) Hence, there shall be an order of interim stay of the operation of the
judgment and decree dated 26.9.2025 made in OS.No.133/2024 on the
file of the Learned II Additional District and Sessions Judge
Arakkonam, till 12.06.2026.
(5) Notice to the respondents through Court as well as privately returnable by
12.06.2026.
(6) Post the matter on 12.06.2026.
