Prayer: Civil Suit is filed under Order IV, Rule 1 of the Madras High
Court Original Side Rules, and Order VII, Rule 1 of Civil Procedure
Code, 1908 praying to declare the letter dated 02.04.2025 issued by the
1st defendant to its members and subsequent letters by the respective
members, i.e., the Defendant Nos. 2 to 24 as null and void and violative
of the earlier MOU dated 10.03.2022 and as not binding on the plaintiff
and its members and consequentially to pass Mandatory Injunction

directing the defendants to adhere to the existing arrangements as per
MOU dated 10.03.2022 and as per the individual agreements between the
members of the defendant Nos.2 to 24 with the members of the plaintiff
council and complete the ongoing movies without any hindrance;
Granting an order of permanent injunction restraining the defendants or
their men or agents or anyone acting on behalf of them from interfering
with the ongoing shooting and pre & post production works for
completion of the ongoing movies without making any hindrance and act
as per the existing arrangements by withdrawing the letter dated
02.04.2025 issued by the 1st defendant and directing the defendants
jointly and severally pay the cost of this suit.

JUDGMENT
This Civil Suit has been filed to declare the letter dated
02.04.2025 issued by the 1st defendant to its members and subsequent
letters by the respective members, i.e., the Defendant Nos. 2 to 24 as null
and void and violative of the earlier MOU dated 10.03.2022 and as not
binding on the plaintiff and its members, and consequentially to pass
Mandatory Injunction directing the defendants to adhere to the existing
arrangements as per MOU dated 10.03.2022 and as per the individual

agreements between the members of the Defendant Nos.2 to 24 with the
members of the plaintiff council and complete the ongoing movies
without any hindrance; Granting an order of permanent injunction

production works for completion of the ongoing movies without making
any hindrance and act as per the existing arrangements by withdrawing

defendants jointly or severally to pay the cost of the Suit.
2. Today, when the matter came up for hearing, both
side learned Counsels represented that the matter has already been
referred to the learned Mediator pursuant to the order of this Court dated
02.07.2025 and the matter has been compromised before the learned
Mediator, Mediation and Conciliation Centre, High Court of Madras.
The Mediation and Conciliation Centre has now forwarded a report along
with enclosing a Memorandum of Compromise dated 01.09.2025 entered
into between the parties.

3. The said Memorandum of Compromise entered into
between the parties is affirmed by the learned Counsels. Both the
plaintiff and the defendants are present before this Court and they
admitted to their signatures and also the terms of the Memorandum of
Compromise.
4. In view of the above, the Civil Suit is decreed as per
the Memorandum of Compromise. There shall be no order as to costs.
Consequently, connected application is closed. The Memorandum of
Compromise dated 01.09.2025 shall form part of the decree. The
Registry may refund the Court Fees in accordance with the rules, to the
Plaintiff, on proper acknowledgment and undertaking.
