                     Prayer: Civil Suit filed under Order IV Rule 1 of O.S. Rules read with
                     Order VII Rule 1 of the Civil Procedure Code praying for a judgment and
                     decree:-

                                  a) directing the defendants to jointly and severally pay to the plaintiff

                     the date of plaint till the date of payment and

                                  b) directing the defendants to pay the entire costs of the suit.

                                                             JUDGMENT

Earlier, when the Suit was posted on 29.08.2024 for hearing, the

Registry was directed to print the name of the plaintiff in the cause list and

to post the matter today.

2. Today, though the name of the plaintiff being printed in the cause

list, he has not chosen to appear before this court.

3.Heard both sides.

4. Learned counsel for the plaintiff has submitted that the defendants'

counsel represented that the matter has already been settled in the Lok

Adalat and to confirm the same, he tried to contact the plaintiff several

instructions from his client. He has also filed a memo to that effect.

5. In view of the submission made by the learned counsel for the

plaintiff and recording the said memo, this Civil Suit is dismissed for non-

prosecution. No costs.
