                     PRAYER: M.P.No.3 of 2015 is filed under Section 173 (1) of the Motor
                     Vehicles Act, 1988, to condone the delay of 359 days in filing the appeal
                     against        the   judgment   and   decree   dated    22.08.2012    made in
                     M.C.O.P.No.159 of 2009 on the file of the Motor Accidents Claims
                     Tribunal, Sub Court, Bhavani.


                                  C.M.A.SR.No.99153 of 2013 is filed under Section 173 of the
                     Motor Vehicles Act, 1988, against the judgment and decree dated
                     22.08.2012 made in M.C.O.P.No.159 of 2009 on the file of the Motor
                     Accidents Claims Tribunal, Sub Court, Bhavani.

M.P.No.3 of 2015 is filed to condone the delay of 359 days in

filing the C.M.A.SR.No.99153 of 2013.

C.M.A.SR.No.99153 of 2013 is filed against the judgment and

decree dated 22.08.2012 made in M.C.O.P.No.159 of 2009 on the file of

the Motor Accidents Claims Tribunal, Sub Court, Bhavani.

2. I have gone through the affidavit filed in support of the petition.

The only reason cited in the affidavit for condoning the enormous delay

of 359 days is that the papers were misplaced and mixed up with other

bundles in transit. Even the date on which the papers were traced is not

given and therefore, I am not satisfied with the reasons stated in the

affidavit filed in support of the petition. Therefore, the delay of 359 days

is not condoned, M.P.No.3 of 2015 is accordingly dismissed and

consequently, C.M.A.SR.No.99153 of 2013 is rejected. No costs.
