PRAYER: Writ Petition filed under Article 226 of the Constitution of India
praying to issue a Writ of Certiorari, calling for the records pertaining to the
proceedings of the 2nd respondent in Na.Ka.No.4034/E-2/2014 dated
08.12.2014, so as to Quash the same since such an enquiry is not authorized
under the provisions of the Tamil Nadu Registration of Marriages Act 2009 and

in contrary to the Matrimonial proceedings pending in HMOP.No.41 of 2012
pending on the file of the Principal Sub-ordinate Judge, Tindivanam,

ORDER
The memo dated 02.01.2023 filed by Mr.V.Manoharan, learned counsel
on record appearing for the petitioner is extracted below:
'MEMORANDUM FILED ON BEHALF OF THE
PETITIONER
1.The impugned proceedings of the 2nd Respondent against
which the above Writ Petition is filed has become redundant in
view of the Judgment and Decree made in H.M.O.P.No.41 of 2012
dated 29.04.2017 on the file of Sub-Court, Tindivanam declaring
that no marriage was solemnized between the Petitioner and the
4th Respondent.
2.The same stood confirmed in Appeal in CMA No.13 of
2017 by Appellate Court's Judgement and Decree dated
14.10.2019 (The Principal District Court, Villupuram) confirming
the non-solemnization of marriage between the Petitioner and the
4th Respondent.
3.The Petitioner subsequently got married on 03.07.2017
and gave birth to a child on 16.10.2019 and is presently settled at
Germany. Hence the matter becomes infructuous.
4.In view of the above developments, it is most humbly
prayed that this Hon'ble Court may kindly be pleased to pass
suitable Orders in the above Writ Petition based on the above and
thus render Justice.'

2.Recording this, this Writ Petition is closed. No costs. Connected
