3.The learned counsel appearing for the appellant submitted that the
order passed in WP(MD)No.7737 of 2005 was confirmed by the Division
Bench of this Court in WA(MD)No.1601 of 2016 on 09.08.2019. The
learned counsel further submitted that while dismissing the writ appeal,
some liberty was granted to the appellant therein.
4.In the considered view of this Court, the issue involved in the
present writ appeal has been substantially dealt with in WP(MD)No.7737 of
2005 and the order passed in the said writ petition was also confirmed by
the Division Bench of this Court. In view of the same, there is absolutely no
necessity for this Bench to once again take up the very same issue.
5.This Writ Appeal stands dismissed, in view of the order passed in
WA(MD)No.7737 of 2005, dated 15.09.2010. No costs. Consequently,
connected Miscellaneous Petition is closed.
