                    Prayer: Writ Appeal filed under Clause 15 of the Letter Patent to set aside

                    the order of this Court, dated 04.06.2021 made in W.P.(MD)No.9789 of

                    2021 and allow the Writ Appeal.

                                                        JUDGMENT

(Judgment of the Court was delivered by S.S.SUNDAR, J.)

The learned Additional Government Pleader appearing for the

appellants submitted that by virtue of subsequent events, the quarry licence

itself was cancelled for violation of provisions of the Tamil Nadu

Preservation of Private Forest Act, 1949 and hence, there is no scope for

sustaining the order impugned in this Writ Appeal. Learned counsel for

the respondent has no objection for allowing the Writ Appeal.

2. In view of the said submission, the prayer in the writ petition

itself does not survive and hence, the order of learned Single Judge

allowing the Writ Petition cannot be sustained. As a result, this Writ

Appeal is allowed and the Writ Petition stands dismissed. No costs.

Consequently connected miscellaneous petition is closed.
