                                                    JUDGEMENT

The learned counsel who filed this second appeal has passed away. The

second learned counsel on record informs the Court that Mr.S.Vellaichamy

informed him during his life time that he had already returned the papers to the

client. The appellant has not made any alternative arrangement. Therefore, this

second appeal is dismissed for non-prosecution. No costs. Consequently,

connected miscellaneous petition is closed.
