                                                    JUDGMENT

[Judgment of the Court was delivered by K.KALYANASUNDARAM, J.]

This appeal has been preferred by the petitioner, aggrieved over the order

passed by the Family Court, Madurai in H.M.O.P.No.633 of 2009.

2. The original petition was filed by the petitioner under Section 9 of the

Hindu Marriage Act, for restitution of conjugal rights. It is now represented by

the learned counsel for the appellant that the original petition filed by the

respondent for divorce was allowed by the trial Court. Though the order was

reversed by the appellate Court, however, C.M.S.A.No.27 of 2017, the divorce

petition filed by the respondent was allowed and the marriage was dissolved on

27.11.2018.

3. In the light of the above, we are of the opinion that nothing survives for

consideration in this appeal. Hence, the Civil Miscellaneous Appeal is dismissed.
