                                                        JUDGMENT

The matter is listed under the caption “for dismissal” today. As seen

from the cause list, the first and fifth respondents are dead and till date, no

steps have been taken to bring on record the legal representatives of the

deceased first and fifth respondents. Learned counsel for the Appellant also

seeks for a short accommodation. The second appeal is of the year 2005. It

can now be inferred that the Appellant is not interested in prosecuting this

second appeal. Accordingly, this Second Appeal is dismissed for non-

prosecution. No costs. Consequently, connected miscellaneous petition is

closed.
